§ 17-0826. Notification of discharges affecting groundwaters.\n Whenever a provision of this title is violated by a facility operating\nunder or pursuant to a SPDES permit and located within an area\ndesignated pursuant to any federal or state statute as a sole source\naquifer, all public water purveyors with a service area or portion\nthereof located within a three mile radius of the violating facility\nshall be notified by the department of such violation if the department\ndetermines that the violation could have a significant impact on the\nwater resources of the area. The department's notices pursuant to this\nsection shall be made within fourteen days of the official notice of\nnoncompliance of the SPDES permit to the violating facility.\n For the purposes of this section "public water purveyor" shall mean\nany person, partnership, public or private corporation, municipality, or\npublic authority which sells water derived from a sole source aquifer to\nat least five service connections or at least twenty-five individuals.\n
