N.Y. Environmental Conservation Law § 71-1711

§ 71-1711. Willful violation of health laws.\n 1. A person who willfully violates or refuses or omits to comply with\nany lawful order or regulation prescribed by any local board of health\nor local health officer, is guilty of a misdemeanor; except, however,\nthat where such order or regulation applies to a tenant with respect to\nhis own dwelling unit or to an owner occupied one or two family\ndwelling, such person is guilty of an offense for the first violation\npunishable by a fine not to exceed fifty dollars and for a second or\nsubsequent violation is guilty of a misdemeanor punishable by a fine not\nto exceed five hundred dollars or by imprisonment not to exceed six\nmonths or by both such fine and imprisonment.\n 2. A person who willfully violates any provision of this chapter\nlisted in section 71-1701, or of titles 17 through 21 inclusive of this\narticle, or any regulation lawfully made or established by any public\nofficer or board under authority of such provisions, the punishment for\nviolating which is not otherwise prescribed by such provisions or any\nother law, is punishable by imprisonment not exceeding one year, or by a\nfine not exceeding two thousand dollars or by both.\n
