N.Y. Environmental Conservation Law § 71-1921

§ 71-1921. Enforcement of section 17-1729.\n 1. Any person putting in or constructing or maintaining a conduit,\ndischarge pipe or other means of discharging or casting any refuse or\nwaste matter in violation of section 17-1729 shall forfeit to the people\nof the state five dollars a day for each day the same is used or\nmaintained for such purpose, to be collected in an action brought by the\ncommissioner.\n 2. The commissioner may maintain an action in the name of the people\nto restrain a violation of section 17-1729.\n
