§ 604-ee. Right of action against person who causes another to incur\ncoerced debt. A person shall not cause another person to incur a coerced\ndebt. 1. A person who causes another person to incur a coerced debt in\nviolation of this section shall be civilly liable to the creditor and/or\nthe debtor in whose name such coerced debt was incurred if such debtor\nhas already paid all or part of such coerced debt, for the amount of\nsuch debt, or portion thereof, including for any deficiency after the\nforeclosure, repossession or surrender and disposition of the subject\ncollateral of a secured debt, determined by the court to be a coerced\ndebt, as well as such creditor's and/or debtor's costs and attorneys'\nfees reasonably incurred in bringing the action.\n 2. An action under this section shall be commenced within three years\nof the later of: (a) the creditor's determination that all or part of\nsuch debt is coerced debt; or (b) a court's determination that all or\npart of such debt is coerced debt.\n
