Performance of duty disability retirement; police and fire department

§ 207-p. Performance of duty disability retirement; police and fire\ndepartment. Notwithstanding any other provision of this chapter or\nadministrative code to the contrary, any paid member of a fire\ndepartment and/or a paid police department, in a city with a population\nof one million or more who successfully passed a physical examination\nupon entry into the service of such department who contracts HIV (where\nthe employee may have been exposed to a bodily fluid of a person under\nhis or her care or treatment, or while the employee examined,\ntransported, rescued or otherwise had contact with such person, in the\nperformance of his or her duties), tuberculosis or hepatitis, will be\npresumed to have contracted such disease as a natural or proximate\nresult of an accidental injury received in the performance and discharge\nof his or her duties and not as a result of his or her willful\nnegligence, unless the contrary be provided by competent evidence.\n
