N.Y. Mil. Law § 130.7

§ 130.7. Apprehension. (a) Apprehension is the taking into custody\nof a person.\n (b) Any person authorized under regulations issued pursuant to this\nchapter to apprehend persons subject to this code, any marshal of a\ncourt-martial appointed pursuant to the provisions of this chapter and\nany peace officer, acting pursuant to his special duties, or police\nofficer may apprehend persons subject to this code upon reasonable\nbelief that an offense has been committed and that the person\napprehended committed it.\n (c) All officers, warrant officers, petty officers, and\nnon-commissioned officers shall have authority to quell all quarrels,\nfrays, and disorders among persons subject to this code and to apprehend\npersons subject to this code who take part in the same.\n (d) Except as otherwise specifically provided in this chapter, no\npeace officer, police officer or marshal of a court-martial shall demand\nor require payment of any fee or charge of any nature for apprehending\nor placing in confinement any person subject to this code.\n
