N.Y. Pub. Health Law § 2325

§ 2325. Houses of prostitution; injunction; withdrawal of complaint.\n1. If the complaint in an action instituted pursuant to the provisions\nof this article, is filed by any person or association, it shall not be\ndismissed except upon a sworn statement made by the complainant and his\nattorney, setting forth the reasons why the action should be dismissed,\nand the dismissal approved by the district attorney in writing or in\nopen court.\n 2. If the judge is of the opinion that the action should not be\ndismissed, he may direct the district attorney to prosecute said action\nto judgment, and if the action is continued more than one term of court,\nexcept for good cause shown, any citizen of the county or the district\nattorney may be substituted for the complaining party and prosecute said\naction to judgment.\n
