Safe disposal of unused medications

* § 2899-o. Safe disposal of unused medications. A person who has\ncustody or control of any unused medication prescribed under this\narticle after the death of the qualified individual shall personally\ndeliver the unused medication for disposal to the nearest qualified\nfacility that properly disposes of controlled substances or shall\ndispose of it by lawful means in accordance with regulations made by the\ncommissioner, regulations made by or guidelines of the commissioner of\neducation, or guidelines of a federal drug enforcement administration\napproved take-back program. A qualified facility that properly disposes\nof controlled substances shall accept and dispose of any medication\ndelivered to it as provided hereunder regardless of whether such\nmedication is a controlled substance. The commissioner may make\nregulations as may be appropriate for the safe disposal of unused\nmedications prescribed, dispensed or ordered under this article as\nprovided in this section.\n * NB Effective August 5, 2026\n
