N.Y. Real Property Actions & Proceedings Law § 1131

§ 1131. Costs. Where costs of a special proceeding taken as prescribed\nin this article are awarded, they must be fixed by the court at a gross\nsum, not exceeding fifty dollars, in addition to disbursements. Where\nprovision is not specially made in this article for the award of costs,\nthey may be denied, or awarded to or against either party, as justice\nrequires.\n
