N.Y. Railroad Law § 102

§ 102. Ventilation of tunnels. The commissioner of transportation is\nhereby authorized, empowered and given full and complete authority to\nrequire and compel all tunnels used or to be used by railroads operated\nby any form of power in this state to be properly ventilated, in such\nmanner and by such means and mechanical appliances as said commissioner\nof transportation may direct.\n
