N.Y. Railroad Law § 53-e

§ 53-e. Unlawful interference with a railroad train. A person is\nguilty of unlawful interference with a railroad train when he wilfully\nwith intent to disrupt, delay, or disturb service, places, causes to be\nplaced, drops, or positions an object or objects of any kind, on, under,\nor upon the tracks which does or could cause physical damage to railroad\nequipment or property or physical injury to passengers or both.\n Unlawful interference with a railroad train is a class D felony;\nprovided, however, that such classification shall not apply in any case\nin which an offense having a higher classification for the purpose of\nsentence is charged under any other provision of law.\n
