N.Y. Town Law § 32-a

§ 32-a. Entry by town engineer on private lands. The town engineer and\nany deputy, assistant or employee of the town engineer's office\ndesignated by him may enter upon any lands, waters or waterways, public\nor private, within the town, without hindrance, for the purpose of\nmaking surveys, examinations or investigations, including the making of\ntest pits and test borings, necessary or convenient in the exercise of\nperformance of any of the other powers or duties conferred or imposed on\nthe town engineer, provided that any test pits or borings made hereunder\nshall be refilled and the real property so disturbed shall be restored\nto its previous condition.\n
