Ohio Rev. Code Ann. § 4715.035

Calculation of time period for recommendation

Effective: April 9, 2025; Latest Legislation: House Bill 238 - 135th General Assembly

Both of the following periods of time shall not be counted for purposes of determining the time within which the secretary and vice-secretary of the state dental board are required to make their recommendation to the state dental board under section 4715.034 of the Revised Code:

(A) The period during which the secretary and vice-secretary suspend the investigation of an individual because the individual is also the subject of a criminal investigation and are asked to do so by the entity conducting the criminal investigation or the secretary and vice-secretary determine it is necessary to do so as a result of the criminal investigation.

(B) The period beginning when the board moves for an order compelling the production of persons or records, as permitted by division (D) of section 4715.033 of the Revised Code, and ending when either of the following occurs:

(1) The court renders a decision not to issue the order.

(2) The court renders a decision to issue the order and the person subject to the order produces the persons or records.
