Rules for approving instruments to reduce drug poisoning

Effective: September 30, 2025; Latest Legislation: House Bill 96 - 136th General Assembly

(A) For purposes of division (D)(4)(b) of section 2925.14 of the Revised Code, and subject to division (B) of this section, the state board of pharmacy shall adopt rules establishing standards and procedures for its approval of types of instruments that are not to be considered drug paraphernalia because they demonstrate efficacy in reducing drug poisoning by determining the presence of a specific compound or group of compounds. The rules shall be adopted in accordance with Chapter 119. of the Revised Code.

(B) Under this section, the board shall not approve any type of instrument to the extent that the instrument is intended to measure the purity of a mixture.
