Okla. Stat. tit. 12, § 1331

Persons who may prosecute writ

R.L. 1910, § 4882.

Every person restrained of his liberty, under any pretense whatever, may prosecute a writ of habeas corpus to enquire into the cause of the restraint, and shall be delivered therefrom when illegal.
