Filing of adopted rules - Effective date of adopted rule or Executive Order

Known as the Administrative Procedures Act

A. Each agency shall file copies of each rule finally adopted by it with the Secretary, as required by Section 251 of this title. B.

1. Each rule finally adopted is effective ten (10) calendar days after publication in "The Oklahoma Register" pursuant to Section 255 of this title unless a later date is required by statute or specified in the rule, the agency rule report, or "The Oklahoma Register", the later date is the effective date. A rule shall only be applied prospectively from its effective date.

a. Subject to applicable constitutional or statutory provisions, an emergency rule becomes effective immediately or at a stated date after certification by the Governor. An emergency rule shall only be applied prospectively from its effective date.

b. The agency shall take appropriate measures to make emergency rules known to the persons who may be affected by them. C. Executive Orders signed by the Governor shall become effective upon the date specified therein or immediately upon issuance.
