In a suit brought under § 42-29-13 [repealed], if the plaintiff shall recover, judgment shall be rendered in favor of the general treasurer or sheriff, as the case may be, for the use of the person alleged in the writ and declaration to be injured by the breach or breaches assigned, and that person shall be deemed and taken, for all purposes whatsoever, to be the plaintiff in the suit.
