Tenn. Code Ann. § 3-6-210

Applicability of §§ 3-6-201 — 3-6-203 — Authority of commission to investigate alleged violations of title 8, chapter 50, part 5 — Petitions considered as contested case

(1) Except as provided in subdivision (b)(1), §§ 3-6-201 — 3-6-203 shall only apply to a complaint alleging a violation of this chapter.

(2) The commission has the authority to investigate any alleged violation of title 8, chapter 50, part 5, upon a sworn complaint by a citizen of this state that meets the requirements of § 3-6-201(b) or upon its own motion. The commission shall only have the power to assess a civil penalty after notice and opportunity for hearing.

(3) A petition filed pursuant to § 3-6-205(a)(1)(B) or (a)(2)(B) may be considered as a contested case under the Uniform Administrative Procedures Act, compiled in title 4, chapter 5.
