Tenn. Code Ann. § 46-1-109

Receiving and holding of grants and bequests

Known as the Cemetery Act

(1) A cemetery company may hold any grant or bequest in money or other property, and shall faithfully apply the grants or bequests for the improvements of the cemetery, or in the erection or preservation of any tomb or monument, according to the terms of the grant or bequest, except those funds required to be held in trust, or paid into the improvement care trust fund as provided by § 46-1-204.

(2) No cemetery company shall accept any special grant or bequest, unless it is in writing and made a part of the permanent records of the cemetery.
