Tenn. Code Ann. § 47-18-2304

Action for injunctive relief and civil penalty by attorney general and reporter

Acts 2017, ch. 257, § 1; 2019, ch. 217, § 1.

(1) The attorney general and reporter may bring an action against a person who violates § 47-18-2302(a) to enjoin further violations and to recover a civil penalty of up to thirty thousand dollars ($30,000) per violation.

(2) Any civil penalty collected pursuant to this section shall be paid into the general fund of the state.

(3) The prevailing party is entitled to reasonable attorney's fees, court costs, and expenses; provided, that no court costs shall be taxed against the attorney general and reporter or this state in actions commenced under this section.

(4) Jurisdiction for an action brought pursuant to this section shall be in the chancery or circuit court of Davidson County.
