Tenn. Code Ann. § 47-26-705

Use of defective measuring devices — Repair — Reinspection

Acts 1977, ch. 138, § 5; T.C.A., § 71-705.

(1) Any defective moisture-measuring device, while so marked, sealed, or tagged, as provided in § 47-26-704, may be used to ascertain the moisture content of agricultural products offered for sale, processing, or storage, only under the following conditions: The owner or user shall keep a record, open to inspection, of every commercial sample of agricultural products inspected by means of the defective device, showing that an adjustment was made on all such agricultural products tested; and

(2) The device shall be repaired to comply with this section within thirty (30) days after inspection and the department thereupon notified that the device has been repaired accordingly.

(3) If, upon reinspection, the device is again rejected under § 47-26-704, such device shall be sealed and shall not be used until repaired and reinspected.
