Enlisted personnel — Period of service

(1) The qualifications for enlistment and reenlistment, the period of enlistment, reenlistment and voluntary extension of enlistment, the period of service, the form of oath to be taken, and the manner and form of transfer and discharge of enlisted personnel of the national guard shall be those prescribed by applicable laws of the United States and by parts 1, 2 and 4-6 of this chapter and by regulations issued thereunder.

(2) Any person who has been discharged under other than honorable conditions from the military forces of this or any other state or from any component of the armed forces of the United States and has not been restored to duty shall not be eligible for enlistment in any force of the national guard.

(3) The governor is authorized to extend the period of any enlistment, reenlistment, voluntary extension of enlistment and the period of service of enlisted personnel of the national guard for, but not exceeding, the duration of an emergency declared by the governor.

(4) Whenever the period of enlistment, reenlistment, voluntary extension of enlistment and the period of service of enlisted personnel of the reserve components of the armed forces of the United States is extended, the governor shall extend the period of enlistment, reenlistment, voluntary extension of enlistment and the period of service of enlisted personnel in the national guard for the same period.
