(1) Irrespective of the date of issuance of a permit, all operators, permittees, and persons, except as provided in subsection (b), shall immediately conform to any statutes enacted, or rules adopted pursuant to those statutes, on the effective date of such statutes and rules. This section does not require the regrading or replanting of any area on which the work was satisfactorily performed prior to the effective date of the statute or rule.
(2) The board shall promulgate rules under § 59-8-103(b)(1) that are consistent with 30 CFR 773.4 concerning continued operations under federal program permits.
