Tex. Ins. Code § 1301.068

INDUCEMENT TO LIMIT MEDICALLY NECESSARY SERVICES PROHIBITED

Added by Acts 2003, 78th Leg., ch. 1274, Sec. 3, eff

(a) An insurer may not use any financial incentive or make payment to a physician or health care provider that acts directly or indirectly as an inducement to limit medically necessary services.

(b) This section does not prohibit the use of capitation as a method of payment.
