REFUND

(a) Subject to Subsection (b), if the board finds that the license holder has committed an act that is grounds for license denial or disciplinary action under Section 801.402, the board or executive director may order a license holder to pay a refund to a consumer as provided in an agreed settlement, default order, or board order instead of or in addition to imposing an administrative penalty or sanction.

(b) The amount of a refund ordered under this section may not exceed the amount the consumer paid to the license holder for a service regulated by the board, and may not require payment of other damages or estimate harm.

(c) This section does not grant the board jurisdiction over a complaint based solely on the cost of a veterinary service.
