(1) In addition to the requirements of Section 58-92-302, an applicant for licensure as a private investigator registrant shall:
(a) submit an application in a form the division approves;
(b) pay a fee determined by the department under Section 63J-1-504;
(c) provide proof to the division that the applicant meets the experience requirement for a private investigator registrant under Section 58-92-307;
(d) file and maintain with the division evidence of a surety bond:
(i) in the amount the division establishes by rule in collaboration with the board and in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act;
(ii) that shall remain in effect throughout the applicant's entire licensing period; and
(iii) that provides that the issuer of the surety bond shall notify the division if the bond is cancelled or expired; and
(e) provide the division any other information required by division rule in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.
(2) A private investigator registrant may engage in private investigation only:
(a) as the employee of a private investigator agent who:
(i) creates a private investigation agency and receives a private investigation agency license; and
(ii) maintains a valid and current private investigator agent license; or
(b) while under contract and supervision of a private investigator agent who:
(i) creates a private investigation agency and receives a private investigation agency license; and
(ii) maintains a valid and current private investigator agent license.
(3) The division may further define the scope of the private investigator registrant license by rule in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.
