Utah Code § 71A-9-303

Certain improvements, alterations, and expansions prohibited

Amended by Chapter 343, 2026 General Session

(1) A person may not begin to develop, or authorize development, on any land on which the department or the Governor's Office of Economic Development holds a lawful easement unless the department or the Governor's Office of Economic Development has affirmatively authorized the development of the land.

(2) Nothing in this part prohibits a property owner from improving, altering, or expanding an existing residential or commercial use of the property owner's property if the improvement, alteration, or expansion does not violate any conditions of an easement placed on the property owner's land.
