Release by law enforcement officer of arCOMMENCEMENT OF CRIMINAL PROCEEDINGS 968.127 rested person. A law enforcement officer having custody of a person arrested without a warrant may release the person arrested without requiring the person to appear before a judge if the law enforcement officer is satisfied that there are insufficient grounds for the issuance of a criminal complaint against the person arrested.
