Discretionary power retained by court

Known as the Uniform Declaratory Judgments Act

The act spans §§ 1-37-101 to 1-37-115 (15 sections).

The court may refuse to render a declaratory judgment where the judgment would not terminate the uncertainty or controversy giving rise to the proceeding.
