Automotive Repair Act

California · BPC · §§ 9880 to 9880.5 · 6 sections

Overview

The Automotive Repair Act regulates commercial motor vehicle repair, setting out the terms on which a repair facility may perform work and charge a consumer for it. It requires written estimates before repairs begin, along with the consumer's authorization to proceed, and imposes further duties when the estimated price proves insufficient, when the vehicle cannot be delivered during business hours, or when the facility cannot finish on time; consumers may waive the estimate in prescribed circumstances. It also mandates itemized invoices, disclosure of any guarantees or warranties, posted notices of consumer rights, and recordkeeping, governs release of the vehicle and bars a repair lien where the act is not followed, and treats violations as unlawful practices, subject to specified exemptions.
