Emergency Interim Legislative Succession Act

Delaware · State Government · §§ 29-1701 to 29-1715 · 15 sections

Overview

The act provides for continuity of legislative operations in the event of an attack or similar emergency, requiring that emergency interim successors be designated in advance for members of the legislature so that someone is standing by to assume a legislator's powers and duties when that legislator is unavailable to serve. It establishes the status, qualifications, term, and oath of those successors, a contingent method of designation if a legislator does not name them, requirements that designations be recorded and published, and the privileges, immunities, and compensation successors receive once they take up a seat; it also addresses how the legislature is convened under emergency conditions and how quorum and voting requirements apply to a body sitting with substituted members. These emergency provisions operate only while the triggering conditions persist and terminate thereafter, and they are placed within the broader body of law governing the legislature's organization, sessions, officers and committees, member compensation, and the taking of testimony.
