Delaware Uniform Interstate Depositions and Discovery Act

Delaware · Courts and Judicial Procedure · §§ 10-4311 to 10-4311 · 1 section

Overview

This act governs how a subpoena issued for a case pending in another jurisdiction is given effect for discovery carried out locally. It establishes the procedure for issuing and serving such a subpoena, the conduct of depositions and the production or inspection of materials under it, and the circumstances in which a foreign subpoena will not be enforced. It also allows parties and witnesses to apply to the local court for relief relating to the subpoena, and directs that its provisions be construed to promote uniformity among the states that have adopted it.
