Genetic Information Privacy Act

Illinois · Public Health · §§ 410-513-1 to 410-513-97 · 27 sections

Overview

The Genetic Information Privacy Act governs the confidentiality of genetic testing information, treating it as protected health information that generally may not be disclosed without the consent of the person tested. It restricts how insurers and employers may obtain or use genetic test results, sets out limited circumstances in which the information may be used or released — including treatment, payment and health care operations, health oversight, public health activities, research, paternity proceedings, and exchange through health information networks — and imposes minimum-necessary and de-identification limits on what may be shared. It also binds anyone who receives the results to the same disclosure restrictions and creates a private right of action, with damages and other relief, for violations.
