Fish Marketing Act

Maine · Stock and Stockholders · §§ 2001 to 2287 · 66 sections

Overview

The act authorizes those who take or produce fish and fishery products to organize as nonprofit cooperative associations for the collective marketing of what they harvest. It supplies the operating framework for such associations — incorporation and articles, share classes and par value, membership and voting power, the financial rights and obligations of members, admission, withdrawal, transfer, suspension and valuation of a departing member's interest, election of directors by geographic district along with officers and an executive committee, and merger or consolidation — with the general corporation law filling gaps not addressed directly. It also grants an exemption from antitrust liability, addresses how securities-dealer registration applies, and provides procedures for charges, notice, hearing and a membership vote where a member or district director is called to account.
