Uniform State Law
Montana · Aeronautics · §§ 67-1-201 to 67-1-214 · 10 sections
Overview
This act governs aircraft and the use of the airspace above a state, declaring the state's sovereignty over that space and defining the extent of the landowner's interest in the space above the surface. It sets the conditions under which flight through that airspace is lawful, and establishes liability rules for damage caused to persons or property on the ground as well as for collisions between aircraft. It also fixes which jurisdiction's law applies to crimes, torts, and contracts arising in flight, and directs that its provisions be interpreted so as to keep aviation law uniform among the states that adopt it.
