Junkyard Control Act

North Carolina · 136 · §§ 136-141 to 136-155 · 16 sections

Overview

The act regulates junkyards, controlling where they may be located and requiring a permit to operate one. Junkyards already lawfully in existence must be screened from view, and where screening is impractical the act authorizes their acquisition, including by condemnation, while junk kept at junkyards operating unlawfully may be ordered removed; enforcement provisions and judicial review accompany these requirements. Administration rests with the state transportation department, which may adopt rules, delegate authority to its secretary, enter into agreements with the federal government, and use federal aid funds, and the act also addresses the effect of zoning changes and alternate methods of control.
