Overview

The act governs the business of consumer lending, requiring anyone who makes loans under it to obtain a license from the state banking authority upon a showing of convenience, advantage, and financial responsibility, and to operate under continuing supervision, recordkeeping, and reporting obligations. It sets the permissible terms of such loans — the rates that may be charged, how interest is computed and payments applied, maximum loan amounts and maturities, and the limited fees allowed — while prohibiting further charges, the splitting of contracts, powers of attorney and confessions of judgment, and false or misleading advertising, and imposing added limits on insurance sold with a loan and on loans to military service members. Enforcement rests on the license and on the regulator's authority to make rules, issue subpoenas, hold hearings, seek injunctions and receiverships, and suspend or revoke a license, with loans made in violation rendered void and certain categories of lenders expressly exempted.
