Partial-Birth Abortion Ban Act

Arkansas · Public Health and Welfare · §§ 20-16-1201 to 20-16-1201 · 1 section

Overview

The act bans the performance of partial-birth abortion and supplies a statutory definition of the procedure it reaches. Liability under the ban does not extend to the patient on whom the procedure is performed, who is expressly immunized. It also establishes conscience protections on the provider side: neither an individual nor a hospital or other health care facility may be compelled to perform the procedure or provide related services, and a refusal to do so gives rise to no liability.
