Unauthorized Insurers False Advertising Process Act

California · INS · §§ 1620.1 to 1620.7 · 7 sections

Overview

The act governs how insurance is advertised, solicited, and sold, defining a range of practices as false, misleading, deceptive, or unfair — and separately barring unfair discrimination in life and health coverage, including discrimination based on sex, marital status, blindness, or status as a victim of domestic violence. Its main mechanisms are affirmative duties paired with penalties: due diligence investigation and written disclosure requirements on producers, insurers, third party administrators, and preferred provider organizations before health benefit plans and stop loss policies are placed; documented supervision procedures and continuing education; misdemeanor liability for certain violations; and suspension or revocation of registration for noncompliance. It also imposes detailed restrictions on marketing life insurance and annuities to active duty service members, defines exclusions, defenses, and mitigating circumstances, protects the confidentiality of notifications while allowing information sharing with other state and federal agencies, and authorizes the insurance regulator to adopt implementing rules.
