Davis drew a draft on A. K. & W. H. Linn, payable thirty-six days after date, for $139.G5 due to him from them for goods sold, and he attaced to thé draft a bill for the merchandise for an equal amount, and the draft was discounted by the bank. Subsequently an action was instituted against Davis, and the Linns were garnisheed, whereupon the bank intervened and claimed the amount due from the Linns.

Gaston and two other Deputy U. S. Marshals, brought suit against 0. P. Fitzsimons, U. S. Marshal, and the securities on his bond, in the U. S. Circuit Court, for the Northern District of Georgia, claiming that various sums of money were due them for fees earned as such deputies; that said sums of money had been collected by said Fitzsimons from the United States, and that he had failed to pay the same over to them.

A charge in a bill that a certain act of the Legislature of Georgi- was about to be declared of force, by reason of a popular vote of the county of Fulton, in pursuance of the statute, which statute prohibited the sale of intoxicating liquors in the counties adopting it, and that some of the plaintiffs were large, liquor dealers, and dealers in foreign wines and wines of other States, and had large stocks on hand, and had license and good will, which in the liquor business is of large value, and that another plaintiff was interested in a chartered brewery, authorized by its charter to make and sell beer, and that the putting and declaring such law of force would materially damage their business, impair thus the contract in the brewery charter, and interfere with their right to sell liquors in the adjoining States, and charging also that the Act of the Legislature, whilst it prohibited, if sustained by a popular vote, the sale of spirituous liquors generally, yet contained a proviso exempting domestic wines from the operation of the Act — present a Federal question, under the Act of Congress of 1875, and the Circuit Court of the United States has jurisdiction to hear and determine such Federal questions.</p> <p>The Act of Congress, section 721 of the Revised Statutes, prohibiting the Courts of the United States from granting injunctions to stay proceedings in any court of a State, etc , does not cover the case of a bill filed praying an injunction against the Ordinaiy of a count}', who, in addition to his ordinary duties as a probate judge, is clothed by a special statute w’ith the duty of counting the votes and examining the returns of a county election on a local option law, and declaring the result.</p> <p>The Act of the Legislature of Georgia, known as the Local Option Law, exempts from its provisions domestic wines, though it prohibits the sale of spirituous liquors, including wines.</p> <p>Held: That it is not competent for a Legislature of a State thus to discriminate between wines made in Georgia and the wines of other States and foreign ' .wines.</p> <p>Whether this clause — this discrimination — makes the whole act void, the Court does not expressly decide, but inclines to the opinion that the proviso making the exemption is void, and the whole Act good.</p> <p>It is competent for the Legislature of Georgia to pass a law to take effect only on the happening of a certain event; and an act prohibiting the sale of spirituous liquors in the State, excepting certain counties from the operation of the Act, and providing that the law should only go into effect in any county after the people, by a popular voto; had so decided, is within the Legislative discretion, and is not conferring the powers of the Legislature to the people of the counties.</p> <p>At an election in Atlanta, Georgia, it was evident that there was not sufficient polling places in two of the militia districts composing the city of Atlanta, for the people to vote at a certain election, and the managers and the Ordinary, and other county officers, on the advice of many citizens of both parties, adopted a scheme to facilitate the voting, by having at'each polling place three' boxes, some 10 or 20 feet apart, and so related to each other as that one manager stood at each box and gave that his special attention, though all ■ joined in the settlement of any questions made, and all were in sight and within a few feet of each box.</p> <p>Held : That whilst it was very doubtful if this proceeding was legal, yet it did not make the election void, unless it were also made to appear that the result would have been different had no such irregularity existed.</p> <p>Election managers and persons clothed ;by law with the duty of receiving the returns of an election, counting and canvassing the votes, and declaring the result, especially with specific power to hear and determine all questions, arising, will not be interfered with by an injunction in the performance of their duties.</p> <p>In this case the plaintiffsAiave a complete and adequate remedy at law, by contest before the Ordinary, or, if not satisfied with the result of-such a contest, then by a contest before the Superior Court, as provided by the local option law. The local option law does not disqualify those sections of the counties having local laws prohibiting the sale of liquor from voting in a county election to determine if the local option law shall gop intojj'operation in the county in which such localities are situated.</p> <p>A registration law directing the books to be closed ten days before the election, and making no provision for the registration or voting of persons becoming qualified to vote after the closing of the books, and before the election, is not void, so as to render the election void, especially if it do,not appear that the result woidd have been different if a provision had been made for such.voteers.</p> <p>Wheu a bill was filed by various liquor dealers charging that their property and contracts and vested rights were about to be seriously damaged by the going into operation of a law to prohibit the sale of liquor.</p> <p>Held: That such act, so affecting private rights, was under the police power of the • State.</p> <p>Held, further: That as the injury claimed was one common to the larger portion of the community, that one or more of a special class could not file a bill to redress the wrong. The bill must be in the name of the Attorney General, who will make the complainants parties, and sue in the name of the State.</p> <p>Injunction refused.</p>

• The plaintiffs are dealers in tropical fruits in Charleston, and the defendant deals in the same product in Savannah, and the parties entered into a contract for the sale of some bananas, not less than two hundred and not more than five hundred bananas, and from twenty-five hundred to five thousand cocoanuts.

Jewell isa cotton mill owner and planter, residing in this district; Woodward, Baldwin & Co'., are commission merchants residing in New York; Jewell would ship the products of his mill to Woodward, Baldwin & Co.; they would sell the same on commission, rendering to him monthly an account of the proceeds; they would make advances to him to enable him to carry on his business, and these mutual dealings had continued from about the year 1870 to April, 1884.

The provision in the Constitution of 1874, which prohibits parties in actions by or against executors, administrators or guardians from testifying as to any transactions with, or statements of the testator, intestate or ward, applies only to the parties to the action and not to those who are not parties, though they be interested in the result of the issue.

<p>Free Pass — Limitation of Liability.</p> <p>A condition in a free pass issued by a railroad company, that the passenger will make no claim for damages for injuries caused by the negligence of the railroad’s servants, is a reasonable one, and will prevent a recovery of such damages, even though the passenger was a minor and the injuries were caused by gross negligence on the part of the railroad employes.</p> <p>The plaintiff was employed by the keeper of a restaurant at a railroad station to sell sandwiches on the train. While so employed he applied for and obtained a free pass, which, at the time of the accident, he was using to make a journey for his own pleasure, and not for the purposes of his business. Held, that the pass could not be considered as issued for a consideration, so as to give plaintiff the right of a passenger for hire.</p>

Under a statute which authorizes a municipal corporation “to ■restrain and regulate the running at large of cattle, horses, swine and -sheep, within the corporate limits, and to distrain, impound and sell the same for any penalty imposed by any ordinance or regulation, and . all cost of the proceeding,” a municipal corporation may, by ordinance, prohibit the running at large of such animals, and authorize the town ■marshal or.policeman to seize, impound and sell the same for…

<p>BILL IN EQUITY TO DECLARE AND ENFORCE A TRUST.</p> <p>1. Acceptance of Trust Express or Implied. — Acceptance of a trust, created by 'will,. deed or other instrument, is ordinarily presumed, and it is not requireto be in writing, nor manifested by express words, but may be inferred from interference with the trust property, or acts done in performance of the duties of the trust.</p> <p>2. Voluntary Interference of Trust — Onus of Proof. — Any voluntary interference with the trust property will be held an acceptance, unless it can be plainly referred to some other ground of action; the onus being on the trustee to show this, and every doubt being re-olved against him. When a sum of money was bequeathed in trust, to be loaned out on bills of exchange or bonds secured by mortgage, the interest to be collected semi-annually by the trustee, and paid over to the beneficiaries; and the administrator of the estate made an arrangement with a mercantile house, of which tire trustee was a partner, to supply the beneficiaries with goods on credit, to be paid out of the semi-annual interest as it accrued, and paid the accounts every six mouths, taking receipts signed by the trustee as such: Hold, that the giving of these receipts showed an acceptance of the trust, notwithstanding the accompanying declarations of the trustee that “ he would not accept the general trust, and the fact that the administrator represented that he only wanted a proper receipt to use as a voucher on his settlement.”</p> <p>.3. Trustee Responsible for laches in Duly. — On final settlement of the administrator’s accounts, a decree was rendered against him, in favor of the trustee, for the amount of the trust funds; whereupon the trustee disavowed the authority to use his name, filed a protest in the probate court, and 'would not allow any process for the collection of the decree to he issued in his name: Held, on these facts, the money being lost by the failure to collect on the decree, that the trustee was liable for the loss.</p> <p>4. Statute of Limitations as to Trusts. — In case of express trusts, the statute of limitations has no application as between the trustee and the beneficiaries, and no length of time short of the period of prescription is a bar, though there are exceptions to this rule, where there has been a settlement, or other final termination of the trust, or an open disavowal and repudiation brought home to the knowledge of the beneficiaries.</p> <p>5. Acceptance and Subsequent Disclaimer of the Trust. — In this case the trustee having accepted the trust, hie subsequent disclaimer did not create a vacancy in the office, nor. authorize the appointment of another trustee; and no loss occurred for ten years afterwards. The trustee lived five years after the loss occurred, and the hill was filed asking the appointment of another trustee, and the recovery of the trust fund within two years after his death : Held, that though the complainant, who has only a life interest, might be barred by laches as to the accrued interest, their claim to the interest accruing in future was not barred, and the rights of the remainder were not affected by the delay.</p>

The facts will be found stated in the opinion. On the evidence the court instructed the jury to find for the defendant, and plaintiff excepted and assigned error.
