¶1Justice of the Peace. — Practice.

¶2This was a certiorari to one of the justices of Chester county. On arguing the case, the judgment of the justice was affirmed.

¶3And, by McKean, Chief 'Justice, it was stated, that conformable to the act of assembly, the defendant, after judgment was given against him by a justice, ought to enter into a recognisance instanter, with, at least, one good surety.(b) He may afterwards withdraw his security, or appeal to the common pleas, within the six days allowed by the act.
