¶1Privilege of freeholder.
¶2A judgment before a justice is sufficient to defeat the privilege of a freeholder.
¶3The defendant being sued by a capias in this action, PEeatly obtained a rule to show cause why the writ should not be quashed, upon proof that the defendant was a freeholder.
¶4Ingersoll and Du Ponceau
¶5opposed the rule, and produced the records of two judgments which had been obtained against the defendant before a justice of the peace, &c.
¶7This is a sufficient ground to defeat the privilege of a freeholder.
¶8Let the rule be discharged.
