Per Curiam :

¶1We held when this case was here before (Barnett v. Plummer, 5 Sad. Rep. 34), that Plummer’s tender was so qualified by the deed, which he at the same time presented for execution, as to render it abortive. As there is nothing in the present case which leads us to a different conclusion, we must affirm the judgment.

¶2The judgment is affirmed.
