<bold>[1] Discovery — Hospitals — Quality Review Records — Statutory</bold> <bold>Immunity — Scope.</bold> The immunity from discovery given the records of a hospital quality review committee by RCW <cross_reference>4.24.250</cross_reference> is in derogation of both the common law and the general policy favoring discovery and will be strictly construed. <bold>[2] Discovery — Hospitals — Quality Review Records — Statutory</bold> <bold>Immunity — Burden of Proof.</bold> The party resisting discovery under the hospital quality review records immunity statute (RCW <cross_reference>4.24.250</cross_reference>) must establish that the information in the records was generated by a regularly constituted quality control review board or committee of the hospital and that the information being protected is found in the records of the proceedings of such a board. <bold>[3] Medical Treatment — Hospitals — Quality Review Records —</bold> <bold>Hospital Privileges.</bold> The termination, suspension, or restriction of a physician's hospital privileges is not immune from discovery under RCW <cross_reference>4.24.250</cross_reference>, which only protects the internal records of a quality review board of a hospital.
