<bold>[1] Statutes — Construction — Superfluous Provisions.</bold> A statute is construed in a meaningful manner which is consistent with its purpose and gives effect to all its provisions. <bold>[2] Juveniles — Juvenile Justice — Capacity — Statutory</bold> <bold>Presumption — Applicability.</bold> The presumption established by RCW <cross_reference>9A.04.050</cross_reference> that children at least 8 but less than 12 years old are incapable of committing a crime applies to juvenile offender proceedings. <bold>[3] Criminal Law — Infants — Presumption of Incapacity —</bold> <bold>Rebuttal — Degree of Proof.</bold> The State has the burden of rebutting the presumption of incapacity of infants, as established by RCW <cross_reference>9A.04.050</cross_reference>, by clear and convincing evidence. <bold>[4] Juveniles — Juvenile Justice — Capacity — Separate Hearing —</bold> <bold>Necessity.</bold> Whether a hearing to determine the capacity of a juvenile to commit a crime should be held apart from the adjudication of the charge depends upon the circumstances of each case. <bold>[5] Trespass — Criminal Trespass — Possession of Stolen Property</bold> <bold>— Sufficiency.</bold> Proof of possession of recently stolen property, without other evidence of guilt, is insufficient to convict a person of criminal trespass. <bold>[6] Statutes — Construction — Unambiguous Statute.</bold> A statute which is unambiguous and clear on its face is not subject to the rules of statutory construction. <bold>[7] Statutes — Construction — Meaning of Words — "Shall."</bold> The term "shall" in a statute is given an imperative meaning unless a contrary legislative intent is manifest. <bold>[8] Juveniles — Juvenile Justice — Crime Victims Compensation</bold> <bold>Act — Applicability.</bold> RCW <cross_reference>7.68.035</cross_reference>(7) requires that a monetary penalty for crime victims compensation be assessed against juvenile offenders. STAFFORD, J., did not participate in the disposition of this case.
