Snediker v. Quick

Supreme Court of New Jersey

Decided September 15, 1832

Supreme Court of New Jersey · decided 1832-09-15

To constitute a legal service of a rule of court, the copy served must be certified under the signature of the clerk of the court.

Decided 1832-09-15

By the court.

¶1— Theobjection is well taken. The copy of the rule is not certified to be a true copy by the clerk of the *246court. Whether it is necessary, that the copy should be under the clerk’s own proper hand writing, may admit of a doubt; but on this point the court express no opinion. The copy of the rule must however be certified under the signature of the clerk.

¶2Motion refused.
