Appellant, Merrilee Stewart, failed to seek leave before filing an appeal in violation of R.C. 2323.52(D)(2). Appellant, TRG United Insurance, LLC, lacks standing to proceed under the trial court's final judgment entry dated August 26, 2020. Motion to dismiss is granted. Appeal dismissed.

Magistrate properly determined that the Supreme Court of Ohio's decision in State ex rel. Klein v. Precision Excavating & Grading Co., 155 Ohio St.3d 78, 2018-Ohio-3890 applied retroactively to the case and that the commission abused its discretion by awarding the injured worker temporary total disability compensation beyond her voluntary retirement date. As the commission weighed the evidence and identified the injured worker's voluntary retirement date, there was no reason to return the matter to the commission. Objections overruled magistrate's decision adopted writ of mandamus granted.
