¶3dissenting.

¶4I respectfully dissent for the same reason of waiver explained in Smith v. State, 192 Ga. App. 604 (_ SE2d _) (1989). The clerk certified by supplemental record that motions were set for hearing on September 14 and that they were withdrawn, as is further indicated on the front of the accusations and on the notice of intent to raise insanity. The letter of September 9 quoted in Smithalso referred to LaRouche’s pending case.
