¶2 IN THE COURT OF APPEALS
¶3 TWELFTH APPELLATE DISTRICT OF OHIO
¶4 WARREN COUNTY
¶5 STATE OF OHIO, :
¶6 Appellee, : CASE NO. CA2024-07-047
¶7 : DECISION - vs - 2/10/2025 :
¶8 JOHN DEE VICARS, :
¶9 Appellant. :
¶10 CRIMINAL APPEAL FROM WARREN COUNTY COURT OF COMMON PLEAS Case No.24CR41644
¶11David P. Fornshell, Warren County Prosecuting Attorney, and Kirsten A. Brandt, Assistant Prosecuting Attorney, for appellee.
¶12The Helbling Law Firm, LLC, and John J. Helbling, for appellant.
¶13 Per Curiam.
¶14 {¶1} This cause came on to be considered upon a notice of appeal filed by
¶15appellant, John Dee Vicars, the transcript of the docket and journal entries, the transcript of
¶16proceedings and original papers from the Warren County Court of Common Pleas, and
¶17upon the brief filed by appellant's counsel.
¶18 {¶2} Appellant's counsel has filed a brief with this court pursuant to Anders v.
¶19California, 386 U.S. 738 (1967), which (1) indicates that a careful review of the record from Warren CA2024-07-047
¶20the proceedings below fails to disclose any errors by the trial court prejudicial to the rights
¶21of appellant upon which an assignment of error may be predicated; (2) lists one potential
¶22error "that might arguably support the appeal," Anders, at 744; (3) requests that this court
¶23review the record independently to determine whether the proceedings are free from
¶24prejudicial error and without infringement of appellant's constitutional rights; (4) requests
¶25permission to withdraw as counsel for appellant on the basis that the appeal is wholly
¶26frivolous; and (5) certifies that a copy of both the brief and motion to withdraw have been
¶27served upon appellant.
¶28 {¶3} Having allowed appellant sufficient time to respond, and no response having
¶29been received, we have accordingly examined the record and find no error prejudicial to
¶30appellant's rights in the proceedings in the trial court. The motion of counsel for appellant
¶31requesting to withdraw as counsel is granted, and this appeal is dismissed for the reason
¶32that it is wholly frivolous.
¶33 BYRNE, P.J., PIPER and M. POWELL, JJ., concur.
