ON CERTIORARI, The action below, was brought by Bloomfield and Marsh against Scudder, on the Timber Act. The state of demand was for cutting 12 trees, 896. The judgment was rendered for 88 41, with costs.

¶1— Here is no judgment for any penalty. It is evident the jury considered the action below, as an action of trespass; for in rendering their verdict they say, we find §8 41 damage; whereas, the action is an action of debt for penalties under the Timber Act.

¶2Judgment reversed.
